The copyright in this Site and all associated material is the property of the TMS and/or its associates. By accessing or using the Site, TMS grants you a limited license to view and otherwise access content on the website, but you are not authorised to use such content or source code for any other purposes, including reverse engineering or copying that con- tent or source code, unless otherwise specified. All other rights are reserved, and, except as outlined above or as otherwise permitted by the Copyright Act 1968, no part of this Site and associated material may be reproduced or published in any form or by any means, electronic or mechanical, including photocopying, recording, or by information storage or retrieval system, without prior written permission from the TMS. 13. If you submit anything to the Site, including on a forum, you agree that the copyright or other intellectual property in that submission belongs to the TMS. 14. The TMS and its employees and other associates are not and shall not be liable for any loss or damage, whether direct, indirect or consequential or otherwise and including any financial loss or damage or loss or damage caused by negligence, resulting from your accessing, using, not accessing or not using the Site, whether as a result of inaccuracies, defects, errors (typographical or otherwise), omissions, out of date information or other- wise. The laws of the State of NSW in Australia apply to this agreement and the parties irrevocably submit to the jurisdiction of the courts in that State. 18. The TMS Privacy Policy forms part of these terms and conditions. 19. The TMS may keep information about your access to and/or use of the Site, but that information will be kept in accordance with the TMS Privacy Policy. 20. If there is any conflict between these terms and conditions and any specific terms and conditions in the Privacy Policy, the Shop terms and conditions or the Forum terms and conditions, then the latter shall prevail over these general terms and conditions. 21. You shall not start court proceedings (except proceedings seeking urgent interlocu- tory relief ) in respect of a dispute arising out of this agreement unless you have first referred the dispute to mediation and, failing resolution, then to arbitration in accordance with the Commercial Arbitration Act 1984 (Vic). 22. No waiver of any default in the strict and literal performance of or compliance with any provision, condition or requirement of this agreement is to be deemed to be a waiver of strict and literal performance of and compliance with any other provision, condition or requirement in this agreement, nor a waiver of or in any manner a release of any party from strict and literal performance of and compliance with any provision, condition or requirement in the future, nor will any delay or omission of any party to exercise any right in any manner impair the exercise of any such right accruing to such party thereafter. 23. If any provision of this agreement is invalid, illegal or unenforceable in any respect the validity, legality and enforceability of the remaining provisions will not be affected and such invalid, illegal or unenforceable provision is to be severed from this agreement. 24. This agreement sets forth the entire agreement and understanding between the Part- ners regarding the subject matter of this agreement and supersedes all prior agreements, understandings and representations. Store Transactions: When you provide credit card information, you warrant that you are fully entitled to use that card and that it has sufficient funds to cover any purchases. When you make payment on the items in your shopping cart, TMS or TMS ‘s nominee will process the payment against your credit card payment instruction details. A printable invoice will be sent via e-mail acknowledging payment once the payment has been processed. Any purchases made via this website will be processed by the St George Bank and will be subject to their usual terms and Engagement: Thank you for accepting our offer to present the Seminar Services to you. By placing an order, you acknowledge that you read our above term and conditions and agree that the placement of an order together with these terms and conditions, forms and contract between you and us. Time and place: Your payment of the investment to us entitles you to: a) Attend the location during the seminar hours to receive the seminar services and b) To receive a copy of the materials. We may change the speakers, the hours, the dates and or the location of the seminar for any reason by not notifying you in writing of the change and detailing substitute Speakers , Seminars, Hours, Dates and or location and: a) We shall have no liability to you; and b) ou shall make no claim against us (including for a refund). In respect of the same. Investment and Payment: 4) You must pay to us in consideration of the Seminar Services: a) the Investment Sum in one lump sum on the placing of the order Form by you without set off , deduction or counter claim; or b) If we have agreed that you may pay by installment, you must pay each installment to us in full in without set off or deduction the installment Sum on the Installment Payment Date. 5) Payments made under this agreement must be made by the means specified in the order 6)If you should not pay to us an Installment Sum by the Installment Payment Date for that sum then All monies owing by you to us shall become due and owing and must be immediately paid to us without set off or deduction or counter claim and without need for further demand. 7) If payments are not made by the due dates, the tickets, the ticket may be cancelled and no refund or credit will be given Cooling off period: 8) If you advise us by the notice in writing within 5 days of placing the Order Form that you do not wish to receive the Seminar Services this agreement shall be at end and we shall refund to you all monies you have paid to us under this agreement. Transferring tickets: 9) In the event that you are unable to attend the event you have booked and paid for, you can transfer your ticket to a nominated new attendee subject to notifying us and providing us with their full contact details at least 60 days before the event starts. The new attendee must also meet any relevant pre- course criteria as applicable at least 60 days before the event starts. An administration fee of $ 495 will apply. Complimentary tickets to any events, including those issued as bonuses when purchasing a main event, may not be transferred either to a new attendee or to an alternative event. Refunds: 10) If, any time or for what ever reason, you decide you do not wish to receive the Seminar Services, you will not be eligible for any refund of any monies you have paid to us under this agreement other than by strict compliance with clauses 8-9. You further acknowledge that this is an essential term of this agreement on which we rely. Complimentary tickets to any events, including those issued as bonuses when purchasing a main event, may not be transferred either to a new attendee or to an alternative event. There are no exceptions to this policy 11) If, any time or for what ever reason, you decide you do not wish to receive the Seminar Services, you will not be eligible for any refund of any monies you have paid to us under this agreement other than by strict compliance with clauses 8 to 10. You further acknowl- edge that this is an essential term of this agreement on which we rely. Complimentary tickets to any events, including those issued as bonuses when purchasing a main event, may not be transferred either to a new attendee or to an alternative event. Disclosures: 12) You acknowledge: (a) that neither we, any of our representatives or any person we engage to perform the Seminar Services ( ‘Relevant Persons’) is an investment advisor or licensed by ASIC or any other government authority to provide investment advice; (b) That the Relevant Person do not purport to provide investment advice or operate an investment advice business (as defined in the Corporations Act 2001); and © We may pay commission to third parties arising from your entering into this agreement. Ticket Sale and Resale 13. Event Tickets may not be transferred, be resold, or be offered for resale at a premium (including via on-line auction sites) or used for advertising, promotion or other commercial purpose (including competition and trade promotions) or to enhance the demand for other goods and services, either by the original purchaser or any subsequent bearer without the prior written consent of TMS. If a ticket is sold or used in breach of this condition, the ticket may be cancelled without a refund and the bearer of the ticket may be refused admission. Scalping warning: The resale of tickets in certain circumstances is governed by ticket sales legislation and may attract criminal penalties. Tuition Information You agree to pay TMS, the tuition amount described for the event selected. Tuition includes the session(s) and application course materials. Transportation, accommodation and food costs are not included.
